Facts

Plaintiff Nancy Valentine was employed by defendant General Nutrition Center as a senior store manager in Ventura County. In January 2009, plaintiff was terminated from her position.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she was terminated after 17 years of employment and replaced with a younger and unqualified male. Plaintiff also claimed that GNC's disciplinary processes were not followed.

DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff was terminated for performance issues; that plaintiff's age and sex were not a factor in connection with any employment decision made by GNC; and, that GNC's policies allowed latitude in disciplinary decisions.

Settlement Discussions

The parties participated in mediation but no settlement was reached.

Result

Defense verdict.
