Plaintiff Denise Wally filed a class action against defendant CCA Industries Inc, which manufactured a line of Mega-T dietary supplement products, including Meta-T Ultra, Mega-T Plus, Mega-T Effervescent, Mega-T Green Tea Dietary Supplement, and Mega-T Dietary Supplement.

Contentions

PLAINTIFF'S CONTENTIONS:
The class contended that defendant used false and misleading advertising on its products and packaging by stating that the products could cause a quick decrease in weight at a maximum of two pounds each week.

DEFENDANT'S CONTENTIONS:
Defendant denied the allegations of wrongdoing and liability.

Result

The parties reached a settlement amounting to $2.5 million. The settlement money will be used to reimburse consumers $10 per product. Additionally, defendant was banned from making unfounded claims on its products and agreed to alter its packaging.
