Facts
Plaintiff Sally Chaaban was employed as an assistant manager for defendant Wet Seal. On December 26, 2006, she was terminated. Plaintiff filed suit against Wet Seal for wrongful termination in violation of public policy.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she was terminated in retaliation for her refusal to work past her shift and complaining to management regarding failure to provide rest and meal breaks and failure to relieve her of her duties after her shift had ended.
DEFENDANT'S CONTENTIONS:
Wet Seal contended that plaintiff was terminated for leaving another employee alone in the store in violation of company policy on the busiest shopping day of the year and that her termination did not violate any public policy.
Settlement Discussions
Defendant made a $20,000(plus costs) settlement offer pursuant to CCP 998.
Result
The jury returned a verdict for the defense.
Other Information
Plaintiff filed a motion for disqualification of Judge Horn and a moved for mistrial prior to jury verdict. The motions are pending in LA Superior Court and as such no judgment has been entered. FILING DATE: Dec. 16, 2008.
