Facts
Rodante Canlas, Delle Canlas, and their company, Nineteene Corp. employed Rosalie Bislig as an overnight caretaker and supervisor within a facility for mentally disabled adults. In July 2008, Bislig brought an action against the Canlases and Nineteene Corp., claiming that they failed to pay her proper wages. Leonilo Bilsig worked sporadically at the facility and also filed a wage claim.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiff alleged that although the adults were sent to a day care center, she was required to be on-call 24 hours per day, performing daytime tasks such as cooking and shopping for food. She contended that she should have received compensation for the overtime hours and meal breaks taken while she was on call.
DEFENDANT'S CONTENTIONS:
Defendants contended that when the adults were at the day care facility between 8 a.m. and 3 p.m. plaintiff was not required to perform her job responsibilities.
Damages
Plaintiffs were employed by defendants for approximately nine years and requested a maximum of $1,350,000 for unpaid earnings.
Result
The parties settled for $125,000.
