Facts

On Dec. 8, 2008, Redwood City police officers responded to a call about an altercation in the parking lot of a Denny's restaurant on Woodside Road at 2:30 a.m. Francisco Huerta, who had been knocked unconscious in the fight, was run over when a police officer pulled into the lot.

Contentions

PLAINTIFF'S CONTENTIONS:
Huerta filed suit against the City, Denny's, and another restaurant.

DEFENDANTS' CONTENTIONS:
The police officer stated that he did not see Huerta due to the parking lot's poor lighting.

Damages

Huerta sought $4 million in damages.

Injuries

Huerta suffered massive facial trauma, multiple abrasions, a basal skull fracture, and chest trauma, as well as loss of hearing in his left ear.

Result

The parties reached a settlement for $1.25 million.
