Plaintiff Robert Brown, a long-haul truck driver, requested transfer from Reno, NV, to Winnemucca, NV. Defendant United Parcel Service Inc. awarded the requested route to a Winnemucca driver who was younger than plaintiff. Plaintiff sued United Parcel Service alleging discrimination and retaliation.

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed age discrimination and retaliation for filing an agency complaint of age discrimination.
DEFENDANT'S CONTENTIONS:
The defense claimed that at all times, it followed the seniority rules set forth in the collective bargaining agreement. The driver who was awarded the route had appropriate seniority under the collective bargaining agreement. The defense further claimed that it did not discriminate or retaliate against the plaintiff.
Damages
At trial, the plaintiff sought $575,000 in economic damages.
