Facts

Plaintiff was the vice principal at Tevis Junior High School in Bakersfield. He was arrested after he brought a gun on campus. Plaintiff had a concealed carry permit for the gun. The loaded gun was found inside his backpack on the floor of his office. He was never charged by the District Attorney's Office.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendants committed negligence, assault and battery, false imprisonment, false arrest, and civil rights violations. Plaintiff sued the City of Bakersfield and two officers, asserting damages for 13 causes of action.

DEFENDANT'S CONTENTIONS:
Defendants contended that plaintiff violated the Gun Free School Act and that there was probable cause to arrest plaintiff because they reasonably believed he had committed a crime by having the gun on campus.

Result

The court granted defendants' motion for summary judgment.
