Facts

On Feb. 15, 2013, plaintiff tripped and fell while walking on a sidewalk located adjacent to property on South Fairfax Ave., in Los Angeles. He sued the owner of the property for negligence and dangerous condition of public property.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he tripped over a raised and uneven slab of concrete on the sidewalk and that defendant created the dangerous condition.

DEFENDANT'S CONTENTIONS:
Defendant contended in her motion for summary judgment that she was not liable because she did not own or control the sidewalk or create the dangerous condition.

Result

The court granted defendant's motion.
