Facts
On Dec. 6, 2009, Nicole Devirian was the passenger in a car driven by Mark Jessee. Mr. Jessee was allegedly driving at an unsafe speed and allegedly made an unsafe lane change on the Interstate 5 Glen Anderson freeway approximately 1,000 feet west of Central Avenue at 10:58 a.m. Mr. Jessee's turning movement allegedly caused him to lose control of the vehicle as it veered to the right across the #4 lane and shoulder and collided with a light pole. Following the collision, the vehicle continued to move in a northeasterly direction and rolled over onto the right shoulder.
Injuries
CAT scans were obtained of the brain, cervical spine, abdomen, and pelvis, showing a lumbar spine fracture at L1, as well as an L5-S1 disc collapse. Ms. Devirian also sustained an acute flexion injury in the upper lumbar and lower thoracic spine. Ms. Devirian was placed in a TLSO brace (thoracolumbar spinal orthosis brace) and had extensive rehabilitation due to her mult-level disc factures. Ms. Devirian underwent an artificial disc replacement surgery at L4 and L5 and L5-S1.
Result
Prior to a complaint being filed, Ms. Devirian received a total settlement amount of $350,000.00.
