James Inman was driving on Main Street with Gus Muniz as his passenger on April 28, 2008, when he was rear-ended by a truck driven by Tracy Jones near the intersection with Placentia Lane.

Contentions

PLAINTIFF'S CONTENTIONS:
Muniz filed suit against Jones and his employer, Lamarr Trucking, alleging motor vehicle negligence and vicarious liability.

DEFENDANT'S CONTENTIONS:
Jones and Lamarr admitted liability, but contended that Muniz's shoulder injury was not caused by the accident.

Injuries

Muniz sustained soft tissue injuries to his neck and back, and underwent chiropractic treatment. Muniz was subsequently diagnosed with a rotator cuff, undergoing surgery.

Result

The parties reached a settlement for $80,000.
