Facts

Mrs. Xiu Huang, 63 years old, was killed after being struck by a San Francisco Water Dept. vehicle as she crossed at the intersection of Miramar and Ocean in San Francisco on Feb. 9, 2010. Mrs. Huang was survived by her husband and three adult children, the plaintiffs in this matter.

The police report was inconclusive in regards to fault, and depicted the pedestrian decedent as having crossed outside the crosswalk. Plaintiffs produced several witnesses who observed the decedent cross with the light and in the crosswalk.

After litigation was commenced, the parties agreed to a mediation before Honorable (retired) Rebecca Westerfield, San Francisco JAMS.

Result

The defendant agreed to settle the matter for $1,556,000, after a full day of mediation.
