Facts

Ruins & Genesta sold vintage textiles and fabrics via an account on eBay. eBay Inc. received reports that Ruins & Genesta had made misrepresentations as to the offered goods. As a result, eBay suspended its account. Ruins & Genesta then filed suit against eBay, alleging breach of contract, breach covenant of good faith and fair dealing, unfair competition, trade libel, disparagement, intentional interference with prospective business advantage, intentional interference with contractual relations, and violation of California antitrust laws.

Result

The court dismissed the claims, finding that plaintiff failed to state a claim, and the eBay user agreement gave eBay the right to suspend plaintiff's account based on the reports.
