Jenna Robertson was riding her bicycle southbound on Alabama Street in San Francisco on June 26, 2008, when she was struck by a vehicle driven by Gregory Keech, who was making a left turn.
Contentions
PLAINTIFF'S CONTENTIONS:
Robertson filed suit against Keech, alleging motor vehicle negligence. She contended that she had the right of way and control of the intersection and that Keech was not paying attention and failed to yield. Robertson alleged she had stopped at a stop sign before proceeding through the intersection, giving Keech enough time to see her.
DEFENDANT'S CONTENTIONS:
Keech alleged he had the right of way and that Robertson's story of stopping at a stop sign was not credible. He further contended that Robertson had the best chance to avoid the accident.
Damages
Robertson sought $14,000 in medical specials, $3,000 in lost wages, as well as $5,000 in property damage.
Injuries
Robertson claimed to suffer soft-tissue injuries to her neck and back, as well as a shoulder impingement and knee derangement.
Result
The jury rendered a verdict for the defense.
