Facts

Alice Ho was walking southbound on Durfee Avenue in El Monte with a friend, when the two were struck in a crosswalk by a vehicle operated by Justin Grossman, who was making a left turn onto Kerrwood Street. Ho and her friend died as a result of the accident.

Contentions

PLAINTIFF'S CONTENTIONS:
Ho's family filed suit against Grossman, alleging motor vehicle negligence. The family contended that Grossman failed to observe and yield to pedestrian traffic.

DEFENDANT'S CONTENTIONS:
Grossman admitted liability, stating he did not see Ho before the accident.

Damages

The family sought damages for wrongful death, and loss of society. They also sought $60,000 in past medical costs.

Injuries

Ho died two days after the accident.

Result

The parties reached a settlement for $750,000.
