Northern California Glaziers, Architectural Metal and Glass Workers Pension Trust Fund sued Ledeit & Sons Glass Inc., in connection with a collective bargaining agreement.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that defendant entered into a CBA with the Union and the Northern California Glass Management Association. Plaintiff alleged that defendant was delinquent in its contributions. Plaintiff sought payment of the contributions plus liquidated and other damages.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various affirmative defenses.
Result
The parties reached a stipulation wherein Ledeit agreed to be indebted to the Trust Funds in the amount of $76,517 plus $37 in interest, subject to $1,733 in liquidated damages, $537 in additional interest and attorney fees and costs of $8,868 and $573, respectively. The agreement was subject to a conditional waiver of the liquidated damages. Ledeit also agreed to remain current in contributions.
