Beautiful Watts, age 6, through her guardian ad litem, filed suit against Melanie Walters.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendant negligently drove her vehicle on a road where an ice cream van and children were present. Plaintiff further alleged that defendant's failure to drive with the necessary caution in such circumstances caused a collision with plaintiff, who was near the ice cream van.
DEFENDANTS' CONTENTIONS:
Defendant alleged she was driving at a safe speed and that plaintiff failed make sure the road was clear before running in front of the ice cream van and into the side of her car. Defendant also contended that plaintiff's parents were not adequately supervising plaintiff.
Injuries
Plaintiff alleged a fractured clavicle, a broken tooth, and a number of bruises and cuts to her head, arms and legs.
Result
After a jury trial, the jury returned a verdict in favor of defendant.
