Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she was riding her bicycle along a marked bicycle lane when she collided with a vehicle driven by defendant. Plaintiff alleged that defendant, who was attempting a right turn at the time the collision occurred, was negligent by failing to yield the right of way to her.
DEFENDANT'S CONTENTIONS:
Defendant partly blamed plaintiff for the accident, citing her inattentiveness.
Damages
Bowman requested $47,000 in past medical expenses and $16,000 in future medical expenses.
Injuries
Bowman claimed she sustained road rash injuries to her limbs. She also claimed a fracture in her right eye socket and a concussion. She later underwent surgery on her right knee from a torn meniscus. She then underwent physical therapy for her knees and hips. Nevertheless, she continued to experience soreness in her right hip and left knee, impacting her abilities to coach lacrosse and her otherwise active lifestyle. She further claimed a future need for surgery.
Result
The parties reached a $96,000 settlement.
