California Drywall was a subcontractor on a veterinary medical facility that was built on the UC Davis campus. California Drywall filed an arbitration matter against Sundt Construction, the general contractor, claiming that because the completion of the job did not meet the initial deadline set forth in its subcontracts, it was owed additional payment for the extra time spent on the job.
Contentions
PLAINTIFF'S CONTENTIONS:
California Drywall contended that despite the fact the job finished on time, it had anticipated an earlier completion of its work and therefore was entitled to be compensated an extra $200,000 in costs for additional time spent on the job.
DEFENDANT'S CONTENTIONS:
Sundt contended that plaintiff was bound to provisions of the prime contract, and thus did not owe defendant any additional payment.
Result
The arbitrator agreed with California Drywall and dismissed the matter.
