On Sept. 25, 2009, Darryl Lively (non-party) was driving a 1999 Honda Civic northbound on Churaposa Street near the South Dakota intersection, in the City of Victorville. Plaintiff Laroyal Brumfield was riding as a front seat passenger. Defendant Donna Blasko was making a left turn when she collided with Lively's vehicle head-on.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that the defended made an unsafe left turn directly in front of Lively's vehicle resulting in the head-on collision.
DEFENDANT'S CONTENTIONS:
Brasko admitted liability but argued that plaintiff's injuries were soft tissue and/or degenerative in nature and that six to eight weeks of physical therapy was sufficient treatment for injuries attributable to the accident.
Injuries
Plaintiff suffered a lateral meniscus tear and a right wrist fracture. He underwent arthroscopic surgery to his left knee and had undergone a couple months of physical therapy.
Result
Defendant accepted plaintiff's CCP 998 offer of $200,000, just prior to jury selection at trial.
