Facts
The U.S. government, on behalf of the U.S. Dept. of Agriculture, Forest Service sued the Southern California Edison Co. (SCE) seeking damages from the James Fire in April 2007.
On April 29, 2007, a fire broke out in Kern County and spread to the Sequoia National Forest. The fire, known as the James Fire, burned approximately 1,320 acres of National Forest System lands.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that the fire was ignited when an SCE power line malfunctioned. Plaintiff further contended that the fire was caused by SCE's negligence and that SCE was strictly liable for the damages caused by the fire.
Result
SCE agreed to pay $1.8 million to settle the matter.
