On July 3, 1995, plaintiff Sandra Cobb Jeffrey, was driving her vehicle at the intersection of East Colfax Avenue and Airport Boulevard in Adams County when she claimed defendant Jonathan M. Bolton made a left turn across traffic in front of her approaching vehicle. The defendant was driving a vehicle that belonged to his father, Edward L. Bolton. Immediately before trial, the plaintiff withdrew her claims against Edward Bolton under the family car doctrine and agreed to dismiss Edward Bolton from the lawsuit. The plaintiff brought this action against the defendant based on negligence. The defendant admitted negligence but denied that the plaintiff was injured by any act or omission on his part, and disputed the extent of plaintiff's claimed injuries.

Settlement Discussions

The plaintiff made an initial settlement demand for $40,000, lowered to $30,000 (per plaintiff). The defendant claimed plaintiff demanded $100,000. The defendant made an initial offer of $5,000, increased to a statutory offer of $9,500.
