Facts

On July 1, 1994, plaintiff Tina Ruark, a grocery checker, was at the intersection of Sheridan and 64th Street when defendant Brenda Richardson struck the rear of the plaintiff's vehicle. The plaintiff brought this action against the defendant based on negligence. The defendant admitted negligence but disputed damages.

Injuries

The plaintiff alleged piriformis syndrome (buttock muscle) which caused pelvic tilt and pain and weakness in the leg; mild, traumatic brain injury resulting in cognitive deficits, chronic headaches, thoracic outlet syndrome; and soft tissue injuries to the cervical and lumbar spine. (The defendant alleged that the plaintiff's headaches and right arm problem were pre-existing conditions, and that plaintiff did not suffer a traumatic brain injury.)

Other Information

The verdict was reached approximately one year and 11 months after the case was filed. The trial court has granted plaintiff a new trial on damages, ruling that the jury did not understand the instructions.
