On July 1, 1994, plaintiff Tina Ruark, a grocery checker, was at the intersection of Sheridan and 64th Street when defendant Brenda Richardson struck the rear of the plaintiff's vehicle. The plaintiff brought this action against the defendant based on negligence. The defendant admitted negligence but disputed damages.

(The defendant alleged that the plaintiff's headaches and right arm problem were pre-existing conditions, and that plaintiff did not suffer a traumatic brain injury.)
