On Jan. 18, 1995, plaintiff Denika Garnet, a 20-year-old student, was rear-ended by a vehicle driven by defendant Charles Seehafer when she came to a stop sign in traffic on southbound Interstate-25 at Broadway. At the time of the accident, defendant Seehafer was acting in the course and scope of his employment with defendant AS&D Construction LLC. The plaintiff brought this action against the defendants based on negligence. The defendants denied causation and disputed the extent of plaintiff's injuries.
