Facts
On Feb. 18, 1995, plaintiff Lisa DeFranco, age 30, was a passenger in a car that was struck while it was stopped on Gray Street near the intersection with 35th Avenue. The plaintiff claimed that the driver of the other car hit her and then drove away, and was uninsured. The plaintiff claimed that the driver of the other was negligent in causing the collision with the car in which the plaintiff was a passenger. The defendant admitted that an accident occurred and admitted that the driver of the hit and run car was uninsured. However, the defendant denied negligence and causation and denied that the plaintiff was injured in the collision.
