Multiple women filed suit against former San Diego Police Officer Anthony Arevalos, arguing that he harassed and sexually assaulted them. In 2012, Arevalos was convicted of sexual battery and sentenced to nearly nine years in state prison.
Jane Roe was one of the women sexually assaulted by former officer Arevalos, and sued the City of San Diego for violation of her civil rights.
Contentions
PLAINTIFF'S CONTENTIONS:
Roe contended that during an arrest in February 2010 for drunk driving, she was handcuffed and placed in the back seat of the patrol car. A bag was placed over her head and tied with duct tape around her throat. Arevalos then climbed in the back seat and sexually assaulted her.
DEFENDANTS' CONTENTIONS:
Defendants denied liability.
Settlement Discussions
First rule 68 offer was $250,000. Second rule 68 offer was $500,000.
Result
The parties settled for $795,000. The settlement includes no finding of liability.
