On Dec. 21, 2009, Cheryl Chin, 33, was driving her Honda Accord when she was rear-ended by Gloria Downs. Chin sued Downs.
Contentions
PLAINTIFF'S CONTENTIONS:
Chin claimed that Downs had been driving negligently.
DEFENDANT'S CONTENTIONS:
Downs admitted liability, stating that she had applied her brakes but was unable to avoid hitting Chin. However, Downs contested Chin's damages, claiming that her treatments were excessive for the type of injury she suffered.
Injuries
Chin was diagnosed with a neck muscle strain, which she treated with massage therapy, physical therapy, pain management, and chiropractic treatment.
Result
The jury found that Downs' negligence had not caused Chin harm, and awarded no damages.
