Tasha Keirsey filed a class action against eBay Inc. alleging breach of contract and breach of the duty of good faith and fair dealing.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant charged excessive fees to eBay members who used the eBay Mobile application. In doing so, plaintiff contended that defendant breached its contract and breached the duty of good faith and fair dealing.

DEFENDANT'S CONTENTIONS:
Defendant denied any wrongdoing or liability. Defendant contended that it properly disclosed all fees related to listing an item for sale with the eBay Mobile. As such, it neither breached its contract nor breached its duty of good faith and fair dealing. Defendant also contended that plaintiff did not have a viable claim.

Result

Without admitting any wrongdoing or liability, eBay agreed to settle for $95,000.
