Facts

Plaintiff Matthew Hetland sued Travis Beauchesne, iClick Promotions LLC, and Playa Negra Enterprises, in connection with a business agreement.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant Travis Beauchesne formed a partnership with him to refer high value merchants to a credit card processing entity in exchange for Beauchesne's agreement to split net profits with Hetland. Plaintiff claimed defendants made fraudulent representations regarding the true commissions realized by the partnership during the course of operation.

Plaintiff further contended that Beauchesne misrepresented the net commissions payable to the partnership as amounting to $30,000 when, in fact, the partnership was paid in excess of $1.4 million.

Plaintiff asserted claims for conversion against Beauchesne's companies, which received the converted funds.

DEFENDANT'S CONTENTIONS:
Beauchesne challenged the existence of the partnership and the attendant obligation to make any payments to Hetland. Beauchesne contended that a partnership agreement was never finalized but, rather, there were only unfinished discussions.

Damages

Plaintiff sought half of his entitled to commissions and punitive damages for Beauchesne's fraud.

Result

Verdict for plaintiff in the amount of $2,181,466. Plaintiff prevailed on counts of breach of contract, conversion, fraud by misrepresentation, and fraud by concealment, money had and received and breach of fiduciary duty. Plaintiff was awarded $731,466 in actual damages against Beauchesne, iClick Promotions and Playa Negra Enterprises. Plaintiff was also awarded $1,450,000 in punitive against Beauchesne after a finding of malice.
