Facts

Judith Monteferrante filed a class action against The Container Store Inc., concerning the store's practice of collecting Zip Codes from customers using a credit card for marketing purposes.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant's conduct violated Mass. Gen. Laws Ch. 93A, which prohibited the collection of personal identification information from customers during a credit card transaction unless for a proper purpose. Plaintiff alleged a cause of action for violation of the consumer law and unjust enrichment.

DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various affirmative defenses.

Result

The parties reached a settlement that would provide each eligible class members with a $10 gift card. The settlement was valued at $877,000.
