Ashlee Arden sued John Castle and Russell Castle, in connection with a motor vehicle accident that occurred on Sept. 15, 2012.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she was driving along on the number one lane of Pacific Ave. in Venice going southbound when she was broadsided by a vehicle driven by defendant John Castle. Plaintiff alleged that defendant was driving on the opposite side of Pacific and attempted to make a left turn right in front of her. Plaintiff sustained injuries as a result and sued defendant for causing the accident.

Plaintiff alleged that the impact caused her vehicle to careen off, strike a post and then a brick wall. Plaintiff alleged that she had the green light and that defendant was negligent in making a left turn in front of her. Plaintiff also alleged that defendant Russell Castle, the owner of the vehicle, was vicariously liable for the accident.

DEFENDANTS' CONTENTIONS:
Defendants disputed the extent of plaintiff's claimed injuries and treatment.

Damages

Arden requested $51,383 in past medical costs and an unspecified amount for future medical costs as well as past and future pain and suffering damages.

Injuries

Arden claimed she sustained injuries to her spine, neck, back and the right side of her body. She treated with physical therapy, chiropractic care, and received epidural shots to manage the pain. However, she claimed she continued to experience pain in her shoulder, neck, and back. She also claimed she would need future surgery on her spine.

Result

The jury rendered a verdict in favor of Arden, awarding her $231,383 in damages. The defense moved for a new trial, but its insurer agreed to pay $236,500 in settlement.
