Facts
On or about April 13, 2004, Plaintiff’s decedent, Henry Portillo, then 10 years of age, was admitted to defendant Harbor-UCLA Medical Center with a diagnosis of leukemia. Thereafter, defendant’s physicians and other personnel commenced diagnostic procedures and treatment, which included the administration of chemotherapeutic agents including 6MP (6-Mercaptopurine) to Plaintiff's decedent. Thereafter, defendant's physicians and nursing personnel administered an excessive amount of said chemotherapeutic agent, which overdose caused or contributed to the death of Henry Portillo on or about May 20, 2004, at UCLA Medical Center.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that defendants failed to properly monitor, administer and follow the proper protocol pertaining to administration of chemotherapeutic agents including 6MP (6-Mercaptopurine) to the plaintiff's decedent.
Settlement Discussions
The parties, prelitigation, agreed to mediate the matter with Troy Roe of Judicate West. The case was mediated a couple of weeks after the filing. However, it was not resolved.
Damages
Wrongful death of 10-year-old boy.
Result
Settlement.
Other Information
This was a MICRA case with no provable economic loss.
