On July 31, 2006, plaintiff Blanca Castro was a pedestrian on Arbor Vitae, in Los Angeles. Castro alleged that a 40-foot truck owned by defendant B&W Lax Truck Repairs Inc. struck her. Castro brought suit.

Castro claimed that B&W was liable for the injury caused by its employee.
