Plaintiff, age 10, was injured while playing tetherball at Noble Avenue Elementary School on Sept. 24, 2007, after the tether wrapped around her finger, severing the distal phalanx of her fourth finger. The minor filed suit against defendant Los Angeles Unified School District. The district filed a cross-complaint against Baden Sports Inc., alleging implied indemnity, comparative indemnity, contribution, and declaratory relief.
Contentions
PLAINTIFF'S CONTENTIONS:
The minor, through her Guardian ad Litem, Coronada Benegas, alleged that the district negligently maintained the facilities.
Injuries
The minor suffered partial amputation at the base of the distal phalanx of the right fourth finger, tenderness, and swelling.
Result
The parties reached a settlement for $27,000.
