Plaintiff Granite State Insurance Co. (Granite) insured Maria Valdez, who on July 1, 2007, was involved in a vehicle collision at the intersection of Terra Bella and Laurel Canyon Boulevard in Los Angeles with four defendants: Cynthia Martinez, the operator of the other car, and three minor passengers. Valdez's policy limit was $30,000. Defendant Dept. of Health Care Services claimed a Medi-Cal lien.
Contentions
PLAINTIFF'S CONTENTIONS:
Granite claimed that defendants' demands were conflicting and exceeded $30,000.
DEFENDANTS' CONTENTIONS:
Defendants claimed that Valdez ran a red light and t-boned them.
Injuries
One of the injured minors claimed amnesia, loss of consciousness, and the existence of repetitive questioning. The minor also claimed seatbelt abrasions to the left collar and neck, soft tissue neck injuries, and injuries to the lower back, chest, and left hand.
Result
The parties settled for a total of $30,000. Martinez received $5,000. Rivera received $5,500. The three minors received $8,000, $1,5000, and $10,000, respectively.
