Facts

On Oct. 12, 2007, plaintiff Robert Hulle was walking behind defendant Kathleen Fisher's car in the parking lot of a business complex located at 2400 N. Ponderosa Drive in Camarillo when the two collided.

Contentions

PLAINTIFF'S CONTENTIONS:
Hulle argued that Fisher negligently backed out of the parking lot.

DEFENDANT'S CONTENTIONS:
Fisher did not contest liability.

Injuries

Hulle claimed aggravation of a pre-existing knee injury, and a contusion and abrasion to his right forehead, causing a brain injury.

Result

A verdict was returned for Hulle and he was awarded $10,175 for future economic loss, $17,000 for past non-economic loss, and $12,825 for future non-economic loss.

Other Information

Hulle moved for a new trial on the basis that the first provided inadequate damages and was subject to abuse of court discretion and attorney misconduct. This motion was denied. FILING DATE: Feb. 19, 2008.
