Facts

On Sept. 13, 2006, a vehicle operated by defendant Luis Valdivia and owned by Luis Valdivia and defendant Tonya Valdivia collided with a vehicle operated by plaintiff Thomas Hooper. Two minors were also in Hooper's vehicle. Hooper and the minors sued the Valdivias for motor vehicle negligence. The Valdivias cross-complained against Hooper for indemnity, apportionment of fault, declaratory relief, and damage to property.

Specials in Evidence

Hooper sought $5,620, one minor sought $1,430, and the other minor sought $1,530 in medical costs.

Damages

Hooper sought to recover property damages in excess of $2,000. The Valdivias sought property damages of $3,225.

Injuries

One of the minor plaintiffs sustained head and neck injuries, and tenderness and muscle spasms in the back.

Result

The parties reached a settlement totaling $9,350. Hooper received $6,650, one minor received $1,250, and the other minor received $1,450. Additionally, the Valdivias recovered $1,613 from Hooper on property damage.
