Facts
On July 9, 2006, plaintiff, six-year-old Gwanu Kim, was at defendant Sun-Rising Presbyterian Church when a metal gate used to secure the church's parking lot fell off its hinges and injured him. Kim sued the church for premises liability.
Contentions
PLAINTIFF'S CONTENTIONS:
Kim contended that the church did not maintain a secure environment as required because it permitted the gate to be left unhinged. Also, Kim claimed that the church should have fixed the problem and failed to warn of the hazard.
DEFENDANT'S CONTENTIONS:
The church contended that Kim climbing and playing on the gate when it rolled beyond the vertical support in place and fell.
Damages
Kim sought $27,389 in medical costs.
Injuries
Kim suffered a fractured tibia.
Result
The parties reached a settlement amounting to $60,000.
