Plaintiffs alleged that Richard Pierce was driving north bound on a street and ran a red light at an intersection and struck the plaintiffs' vehicle that was traveling eastbound at the intersection. Plaintiffs argued that Karla, who was driving, had a green light and Dolores and Miriam were passengers in the vehicle.

Defendant claimed plaintiffs alleged collusion between defendant and the independent witness.
