Plaintiff Michael Lundin was a backseat passenger in a car seat. The defendant rear-ended that plaintiff's vehicle, causing the driver's seatback to fail and strike the plaintiff.

The plaintiff alleged negligent driving and negligent entrustment, as the truck driver lied on his application but the company did not follow up. The defendant contended that the plaintiff was not injured severely, as his pediatric neurologist examination showed most functions within a normal level.
