Plaintiff Marnie Carter twisted her ankle when she stepped into a pothole at the intersection of Pine and Front Streets in San Francisco at 8:40 a.m. on March 15, 2004. She sued defendant city and county of San Francisco for premises liability.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended defendant was aware of the offending pothole but failed to repair it or warn pedestrians of the danger. As a result, plaintiff twisted her ankle when she stepped off the curb into the pothole, then fell onto the roadway trying to recover her balance.
Injuries
The plaintiff suffered severe and permanent injuries to her left foot and ankle. Stephen Carter claimed loss of consortium.
Result
City and county of San Francisco Board of Supervisors approved a $100,000 settlement.
