On Dec. 21, 2005, plaintiff, a 35-year-old Huntington Beach police officer, was injured when defendant Morgan Drolet attempted to make a left turn onto El Camino Real in San Clemente. The defendant collided with plaintiff on his motorcycle and knocked him off. He sued defendant for motor vehicle negligence.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended defendant was stopped at a stop sign on Avenida Serra, then collided with plaintiff as he attempted to make a left turn. The impact knocked plaintiff off the motorcycle, causing his injuries.
DEFENDANT'S CONTENTIONS:
The defendant contended he never saw plaintiff prior to the collision because tall bushes and light poles obstructed his view. He conceded liability in the accident.
