Justin Malone sued the Los Angeles County-USC Medical Center; Cedars-Sinai Medical Center; Ali Khoynezhad, M.D., andDoe defendants, in connection with a motorcycle accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was involved in an accident on a motorcycle in September 2010. He was initially treated at Cedars-Sinai where he underwent surgery to repair a rupture in his heart with a large stent graft. In October 2011, he collapsed while engaging in sports and was taken to LAC-USC Medical Center. His condition thereafter deteriorated due to poor circulation. Consequently, his spinal cord was affected and he was rendered paralyzed. Plaintiff alleged that defendants were liable for medical malpractice due to their failure to treat his condition, which ultimately led to his paralysis.
Result
The parties reached a $4.5 million settlement, plus a waiver of medical payments to the county for $790,000, and assumption of the approximately $200,000 Medi-Cal lien.
