Joanne Gary sought recovery from her insurance company Mid-Century Insurance Company after she was involved in a collision with an uninsured motorist.

PLAINTIFF'S CONTENTIONS:
Gary contended that she was involved in a car accident with an uninsured motorist on January 16, 2014. She alleged that the motorist went through a stop sign at a four way intersection and broadsided her vehicle. She claimed injuries to her back, shoulder, neck and head. She underwent a few months of physical therapy but claimed she still had residual pain, which affected her work performance. She sought recovery from her insurance company Mid-Century Insurance Co. under the uninsured motorist provision in her policy.
DEFENDANT'S CONTENTIONS:
Mid-Century admitted that the uninsured motorist was responsible for the accident but refuted causation and damages.
Settlement Discussions
Plaintiff made a demand for $235,000 (the insurance policy limit) and was offered $48,000.
Damages
Gary sought $70,000 for medical costs and pain and suffering damages.
Result
Gary received an arbitration award of $224,000.
