Facts

Hyun Jang sued J.S.M. Heyri Inc., CCL Coffee Co. Inc., Jae Ma, and Sung Ma, in connection with a business dispute.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was a business owner who allegedly became an investor of defendant CCL Coffee dba Heyri Café in 2006. Plaintiff allegedly invested $200,000 for 20 percent shareholder interest. Plaintiff initially received distributions, but soon thereafter, the parties allegedly entered into another agreement, which provided for plaintiff's waiver to her right to receive distributions for five years. In exchange, CCL Coffee agreed to sell the café within that time frame and refund plaintiff's investment, plus interests, out of the proceeds of the sale. Five years later, plaintiff learned that the company had been secretly dissolved and its assets transferred to J.S.M. all done in an effort to avoid paying plaintiff. Plaintiff then sued the companies and its owners, alleging breach of contract and fraudulent transfer of assets.

DEFENDANTS' CONTENTIONS:
Defendants denied the allegations.

Settlement Discussions

Jang demanded $275,000, which defendants countered with a $30,000 offer.

Damages

Jang sought recovery of her principal plus interest.

Result

The judge ruled in favor of Jang and awarded her $400,000 in damages, which included both principal and interest in equal amounts.
