Defendant, a chiropractor, allegedly digitally penetrated plaintiff and fondled her during a treatment. Defendant also allegedly tried to kiss plaintiff. Plaintiff called police after the incident and defendant was later criminally prosecuted on charges of sexual battery and sexual penetration by a foreign object. Plaintiff sued defendant, asserting causes of action for sexual battery, intentional infliction of emotional distress, battery, sexual harassment, and invasion of privacy.
DEFENDANT'S CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses.
Settlement Discussions
Plaintiff demanded $300,000. Defendant offered $60,000.
Damages
Bounds sought $3.5 million in damages.
Result
The jury found in favor of Bounds and awarded her $320,000 in damages, which included $20,000 in punitive damages.
Other Information
Ghodousi pleaded no contest to criminal assault and battery in connection with the incident, and received four years' probation. Additionally, he was required to surrender his license. A restraining order was also put in place.
