Facts

On June 27, 2014, Susan Tague, 59, went to the emergency room at Orange Coast Memorial Medical Center after she injured her right knee in a slip and fall accident at her home. She suffered a vascular compromise and subsequently underwent an above-the-knee amputation. She sued the medical center and various medical professionals who treated her, including surgeon Timothy Gibson, M.D., for breach of medical and professional obligation. Her husband sued for loss of consortium.

Contentions

PLAINTIFF'S CONTENTIONS:
Tague contended that although Dr. Gibson was given sufficient information to know that her condition needed immediate surgical intervention, he failed to come to the hospital to evaluate her. He also failed to take steps that would ensure that her condition was addressed appropriately.

DEFENDANT'S CONTENTIONS:
Dr. Gibson contended in his motion for summary judgment that he complied with the standard of care required of him with respect to his care and treatment of Tague.

Result

The court granted Dr. Gibson's motion. Plaintiff had filed a notice of non-opposition.
