Plaintiff landlord brought an unlawful detainer action against his tenant for property located in San Francisco.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant failed to maintain her unit in a clean and sanitary condition due to clutter, trash and personal property accumulated and stored throughout the rental unit that made entry and exit into and out of the unit impossible.

DEFENDANT'S CONTENTIONS:
Defendant contended in her demurrer, that the complaint was defectively verified, and therefore could not support an action for unlawful detainer. She also argued that the pleading was improper and that the complaint was not truthful.

Result

The court dismissed plaintiffs' first amended complaint with prejudice.
