Facts

Allison Bradley sued Charles Scheulke and Bassco Services Inc., in connection with a motor vehicle collision that allegedly occurred on April 15, 2013.

Scheulke was let out of the case prior to trial.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was driving on heavy traffic when defendant rear-ended her with his pickup truck. Plaintiff was injured as a result and sued the driver and his employer for negligence and vicarious liability.

DEFENDANTS' CONTENTIONS:
Bassco disputed liability. Bassco also disputed the extent of plaintiff's claimed back injuries.

Settlement Discussions

Bradley demanded $1 million in settlement. Bassco offered her $370,000.

Damages

Bradley claimed she would need a lumbar fusion procedure and further injection therapy. She also claimed she would need replacement dental implants every 20 years. Bradley sought $3.2 million in total damages.

Injuries

Bradley contended that the impact caused her face to smash against her car's steering wheel, causing her to lose several of her teeth. She also suffered from soft-tissue injuries to her back, shoulders, knees, hips and knees. She was later diagnosed with disc herniation on her lower back, requiring various injections. She also underwent dental implant surgery. Despite treatment, Bradley claimed she continued to experience chronic back pain, preventing her from enjoying activities she previously enjoyed.

Result

The jury found Bassco negligent and that its negligence was a substantial factor in causing Bradley's injuries. It then awarded Bradley $2,894,227 in total damages, consisting of $99,428 in past medical expenses, $903,753 in future medical expenses, $16,045 in past lost earnings, $125,000 in past pain and suffering, and $1.75 million in future pain and suffering.
