Plaintiff Anne Morris brought an action against defendant Lebhar-Frideman Inc. as lead plaintiff of a class of plaintiffs made up of Lebhar employees, who were terminated between Aug. 26, 2004 and Jan. 1, 2008. Morris sued for retaliation, sex discrimination, disability discrimination, failure to accommodate disability, Labor Code violations, wrongful termination, intentional infliction of emotional distress, breach of contract, failure to pay wages, overtime, and meal and rest periods, failure to keep adequate records, and failure to provide accurate itemized earnings statements. The class' claims included failure to pay accrued vacation time, failure to pay earnings due at termination, conversion, and unlawful, unfair, and fraudulent conduct.
Damages
Morris requested $465,000 and sought recovery of unpaid earnings and vacation time, and punitive damages for the class.
Injuries
Plaintiffs alleged emotional distress.
Result
The parties settled for $145,000. Lead plaintiff Morris was given an extra $5,000.
