On Nov. 26, 2007, Jose Padilla was in the front, right passenger seat of a vehicle. As he was leaning out of a window, Edward Arnaudo's vehicle struck Padilla from behind. Padilla sued Arnuado.
The defendant, who was of advanced age passed away shortly before trial and the action continued against his estate.
