Facts

On Nov. 26, 2007, Jose Padilla was in the front, right passenger seat of a vehicle. As he was leaning out of a window, Edward Arnaudo's vehicle struck Padilla from behind. Padilla sued Arnuado.

The defendant, who was of advanced age passed away shortly before trial and the action continued against his estate.

Plaintiff contended that the defendant was negligent in the operation of his vehicle.

DEFENDANT'S CONTENTIONS:
Arnaudo admitted liability, but contested the alleged speed of impact.

Padilla claimed $25,000 in medical expenses and $17,500 in lost business.

Injuries

Padilla claimed injuries to his neck and upper back, as well as fractured teeth.
